CCH Tax Day ReportLegislation has been introduced that would provide that a retailer is presumed to be liable for South Carolina sales tax if the retailer enters into an agreement with a South Carolina resident under which the resident, for a commission or other consideration, directly or indirectly, refers potential customers, by an Internet website link or otherwise, to the retailer. The rebuttable presumption only applies if the retailer’s gross proceeds of sales attributable to purchasers who were referred to the retailer pursuant to such agreements in the aggregate exceed $10,000 in the prior twelve calendar months.S.B. 214, introduced in the South Carolina Senate on January 10, 2017
